Return Policy:

Do we accept returns?

Maybe. Sort of. It's complicated.

Every garment we create is one of a kind, and tailored to your specifications and the measurements you submitted, if you sent measurements.

Because of the custom nature of our products, we don't accept returns. However, we do stand by our guarantee of fit as long as you submitted your measurements. If you submitted measurements and your garment does not fit properly, we will alter it at no charge to you, within 14 days. You will pay shipping to return the item to us for alterations. You must contact us within 14 days of your purchase.

If you did not provide measurements, and you would like to alter the garment in order to fit you better, you will pay a small alteration fee, plus shipping back to you (in addition to shipping the item back to us).

We are all unique, and we all have very different bodies. We strive to make clothing that fits beautifully. It always helps me when customers send as much information as possible. Send your IG, so we can see photos of your body type, etc. All of this is helpful to ensure that your garment will fit perfectly.

Welcome to MaggieDelena Latex. These Terms of Service (“Terms”) govern your access to and use of our website, products, and services. By visiting or making a purchase on www.MaggieDelena.com, you agree to be bound by these Terms.

1. General Information

1.3 Products: We specialize in custom-made, high-quality latex clothing. All products are made to order and tailored to your specifications.

2. Eligibility

You must be at least 18 years old or have the permission of a parent or guardian to use our website. By placing an order, you confirm that you meet this requirement.

3. Custom Orders

3.1 Measurements: We include custom tailoring in our pricing, which means that customers must provide accurate measurements for custom orders. We are not responsible for garments that do not fit properly if custom measurements are not provided. There is a space on every garment to include measurements, along with a list of the specific measurements needed (at minimum) to ensure a custom fit. If you are not sure, please feel free to e-mail.
3.2 Design Approval: Design customization will require written approval before production begins.
3.3 Production Time: Custom items may take 4–8 weeks to produce, depending on the complexity of the order. Estimated timelines will be provided at the time of order confirmation.
3.4 Modifications: Any requests to modify an order must be submitted within 48 hours of purchase and may incur additional fees.

4. Pricing and Payment

4.1 Pricing: Prices are displayed in USD. We reserve the right to change pricing at any time without prior notice.
4.2 Payment Methods: We accept all major credit cards, and Paypal. Full payment is required at the time of order placement.
4.3 Taxes and Fees: Customers are responsible for any applicable taxes, duties, or import fees. Residents of Florida must pay 7% sales tax.

5. Returns and Refunds

5.1 Custom Items: Due to the custom nature of our products, all sales are final. No refunds or exchanges will be accepted for custom orders unless there is a manufacturing defect. We will alter or resize a garment at no charge IF full measurements were provided and the item does not fit properly. See our "Returns" section above for detailed information.
5.2 Defective Items: If an item arrives damaged or defective, please contact us within 7 days of delivery with photos of the defect.

6. Care and Maintenance

Latex clothing requires specific care. Please refer to our care sheet included in each order for detailed guidance. We are not liable for damage caused by improper care.

7. Intellectual Property

All content on our website, including designs, images, and text, is the property of MaggieDelena and protected by intellectual property laws. You may not reproduce, distribute, or use our content without prior written consent.

8. Limitation of Liability

We are not responsible for:

Allergic reactions to latex materials.
Damage caused by misuse or improper handling of the product.
Delays due to unforeseen circumstances, including shipping delays or material shortages.

9. Shipping

9.1 Domestic Shipping: Shipping rates and delivery times vary based on your location.
9.2 International Shipping: Customers are responsible for any customs duties or import taxes.
9.3 Lost Packages: We are not responsible for packages lost or delayed by the courier.

10. Privacy Policy

Your personal information is handled according to our Privacy Policy. By using our site, you consent to our use of your information as outlined.

11. Amendments

We reserve the right to update or modify these Terms at any time without prior notice. Continued use of the site constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of Florida, without regard to conflict of law principles.

CUSTOM LATEX MATERIALS AND GARMENTS - TERMS

Custom Garment Commission Policy

Reproduction of Custom Garments
- When you commission MaggieDelena Latex Design to create a custom latex garment, unless explicitly discussed and agreed upon in writing, you acknowledge that the design of the garment is not exclusive to you.
- MaggieDelena Latex Design retains the right to reproduce the garment for other clients who express interest in the design, including through photos or other promotional materials showcasing your commissioned piece.
Ownership of Design
- The design of any custom latex garment remains the intellectual property of MaggieDelena Latex Design.
- While your garment is tailored to your specifications, MaggieDelena Latex Design reserves the right to incorporate elements of the design into future collections or other custom orders.
Exclusive Rights Requests
- If you wish to ensure that your garment design remains exclusive and will not be reproduced for others, this must be discussed and agreed upon prior to the commencement of the project. Additional fees may apply for exclusive rights.
Photos and Promotional Use
- By commissioning a custom garment, you consent to MaggieDelena Latex Design using photos of the finished piece for marketing, promotional, and portfolio purposes.
- If you do not wish for photos of your garment to be shared publicly, please notify us in writing before the garment is completed.
Creative Control and Adjustments
- While we strive to fulfill your design vision, minor adjustments may be made during the creation process to ensure the quality and structural integrity of the garment.

Custom Material Use Policy

Non-Exclusive Use of Materials
When a customer requests custom latex colors or printed latex in custom colors, it is understood that the material ordered is not exclusive to the customer. All material cost must be paid by the client. Due to the high cost and nature of custom latex materials, any leftover sheeting from the order will remain the property of MaggieDelena unless the client orders additional garments within 6 months, or wants the excess material back.
Use of Leftover Materials
Any surplus material or scraps from your custom order may be used by MaggieDelena after 6 months for the following purposes:
- Creation of one-of-a-kind designs or samples.
- Production of garments for other clients or collections.
Ownership of Custom Designs
While the custom material is based on your requested specifications, the resulting designs or garments created from any surplus material are the sole property of MaggieDelena latex.
No Guarantee of Exclusivity
By placing a custom material order, you acknowledge and agree that exclusivity of the material cannot be guaranteed, and MaggieDelena retains the right to repurpose the material as outlined above.
